Understanding Standard Minimum Attorney's Fees: A Move Towards Fair Legal Practice

In an effort to ensure fairness, professionalism, and uniformity in legal services, the Integrated Bar of the Philippines (IBP) Cebu Province Chapter and IBP Cebu City Chapter jointly passed a Resolution on Standard Minimum Attorney’s Fees, which officially took effect on January 15, 2023. This resolution was approved by the respective Boards of Officers of both local chapters after thorough consultation and deliberation.


Why a Standard Minimum Fee?

Many clients often wonder why lawyers charge similar baseline rates for certain services, such as drafting contracts, notarizing documents, preparing affidavits, processing business registrations, or representing clients in court. The answer lies in the enforcement of standard minimum legal fees, which serve as a benchmark for professional charges across the legal community. These fees help maintain the dignity of the legal profession while also protecting the public from either being overcharged or receiving

subpar legal service due to underpricing.


By establishing minimum rates for common legal services, the IBP aims to:

  • Prevent undercutting among lawyers, which could compromise the quality of service.

  • Uphold the integrity and value of legal expertise.

  • Promote transparency and fairness in client-lawyer engagements.

  • Educate the public about the fair value of professional legal services.


These fees do not prevent lawyers from charging higher, depending on the complexity, urgency, or nature of the legal matter. Rather, they ensure that no attorney goes below the minimum threshold, reinforcing a standard of ethical practice and quality assurance.


Who is the IBP?

The Integrated Bar of the Philippines (IBP) is the official organization of all Filipino lawyers, established under Republic Act No. 6397 and recognized as the national organization by the Supreme Court of the Philippines. With its mandate to elevate the standards of the legal profession, improve the administration of justice, and enable lawyers to discharge their public responsibilities more effectively, the IBP plays a vital role in regulating legal practice across the country. Each province and city has its own chapter, which addresses the needs and concerns of lawyers in their respective localities.


The issuance of this joint resolution by the IBP Cebu Province and Cebu City Chapters underscores their commitment to ethical legal practice, professionalism, and the protection of both the legal community and the public.

Clients are encouraged to inquire about the standard rates when engaging legal services to better understand the value of what they’re paying for. While fees may vary depending on circumstances, minimum rates ensure that clients receive competent, diligent, and fair legal representation.
